BIOGRAPHY

Jim Scott is a successful trial lawyer who represents companies and individuals in their most complicated and contentious business disputes. His business litigation experience includes private equity and post-acquisition disputes, partnership disputes, contractual and business fraud disputes, breach of fiduciary matters, misappropriation of trade secrets, and product liability.  Mr. Scott’s financial litigation experience includes lender liability claims, fraud, borrower/guarantor defaults, and foreclosure disputes.  His oil and gas litigation experience includes lease interpretation issues, royalty payment issues, surface use disputes, lease termination disputes, and joint operating agreement disputes. 

Mr. Scott also has extensive experience in handling pre-judgment remedies such as temporary restraining orders, temporary injunctions, garnishments, and receiverships when trade secrets, collateral or business mismanagement is at issue and immediate relief is needed from the court.

Additionally, Mr. Scott regularly serves as outside general counsel for companies that need an experienced business advisor. He helps them identify, manage, and reduce risk, evaluate insurance coverage, develop safety programs for reporting and avoiding accidents, and find ways to reduce and avoid litigation.

EXPERIENCE AND HIGHLIGHTS
  • Obtained a $7.5 million jury verdict/judgment on behalf of mining company against rock crushing manufacturer regarding warranty and negligent misrepresentation claims after two-week trial
  • Successful take nothing defense verdict for oil and gas manufacturer in weeklong jury trial sued for vicarious liability regarding alleged assault by the CFO
  • Successful take nothing defense verdict for tree stand manufacturer in weeklong jury trial sued for product liability claims seeking $30 million in damages
  • Successful settlement on courthouse steps for ag lender sued for alleged fraudulent loan terms regarding the purchase of a historic Texas ranch seeking over $100 million in damages
  • Obtained a $700 thousand jury verdict/judgment for individual in a weeklong jury trial regarding fiduciary breaches and fraud over a partnership for real estate development
  • Successful take nothing defense verdict for individual in weeklong jury trial sued for alleged trade secret misappropriation and fiduciary breaches seeking over $4 million in damages
  • Successful take nothing defense verdict for energy consultant in weeklong jury trial sued for breach of contract regarding services provided on a well in East Texas
  • Successful take nothing defense verdict for HVAC manufacturer in weeklong bench trial sued for product liability claims seeking hundreds of thousands in damages
  • Successful summary judgment for bank sued for approximately $45 million for alleged breach of contract, fraud, DTPA and conspiracy regarding the financing of a telecommunications company
  • Reversal of $2.5 million judgment against oil and gas client sued for breach of contract regarding a joint exploration agreement and acquisition of mineral acreage in East Texas
  • Successful argument before the Texas Supreme Court resulting in a reversal on a jurisdictional issue of first impression
